The Committee on Senior, Children, and Family Issues moved to amend the bill by striking everything after the enacting clause and inserting in lieu thereof the following:
(a) Definitions. – As used in this section the term:
(1) "Child care center" means any child care facility providing nonresidential child care for seven or more children for all or part of a day. Child care center includes day care centers and family child care homes. Child care center does not include:
(A) A kindergarten, preschool or school education program operated by a public school, accredited by the state department of education;
(B) An individual or facility which offers occasional, temporary care of children for
brief periods while parents are shopping, engaging in recreational activities, attending religious services or engaging in other business or personal affairs;
(C) Summer recreation camps operated for children attending sessions for periods not exceeding thirty (30) days;
(D) Hospitals or other medical facilities which are primarily used for temporary residential care of children for treatment, convalescence or testing; or
(E) Persons providing family day care solely for children related to them, including grandparents, aunts and uncles.
(2) "Child care services" means direct care and protection of children during a portion of a 24-hour day outside of the child’s own home.
(3) "Child care employee" means any person who works in a child care center and provides child care services.
(4) "Family child care homes" means any home providing nonresidential child care for compensation for four to six children, including children who are living in the household who are less than six years of age.
(b) The Department of Human Services shall subsidize child care centers, including family child care homes, within the state for providing child care services to children of child care employees who work a minimum of 20 hours per week, regardless of income.
(c) The Department of Human Services shall promulgate emergency rules and propose legislative rules for legislative approval in accordance with the provisions of §29A-3-1 et seq. of this code necessary for the establishment of this subsidy no later than 90 days after the effective date of this section.
(d) Effective July 1, 2027, the provisions of this section shall sunset and have no further force and effect."
